Product manufacturers, distributors, and retailers can be held liable when product that they put on the market cause injury or death. Products liability claims may focus on product design, manufacturing defects, or because of inadequate warnings or instructions. The causes of action are generally negligence, strict liability, and, in some instances, breach of warranty. The strict liability cause of action lessens the burden of proof for the injured victim—the plaintiff only needs to prove that there is a defect in the product and that the defect caused an injury. If established, the defendant is considered fully responsible regardless of whether it knew or should have known of a problem with the product and acted in a reasonable manner.
